                                      TERMS & CONDITIONS OF SALE

(STRICTLY 30 DAYS FROM RECEIPT OF INVOICE) 

Returns & Credits.

These are only accepted if authorised by us, the supplier or our agent, and are notified within seven (7) days of receipt of goods.  Goods may only be returned by carrier approved by us.

A handling charge of 10% invoice value will apply to returned goods.

Property of Goods.

The property in the goods passes to the purchaser, only after the price of the goods has been paid in full.  Jipp Pty. Ltd., Trading as Sure Gro reserves the right at any time to collect and claim possession of unpaid goods when in the possession of the customer, when gods have not been paid for in full.  Proceeds of sale will remain the property of Sure Gro if proceeds are from unpaid goods.  Any costs associated with the recovery of unpaid goods will be added to any outstanding invoices.  It is an express condition of supply, that if the applicant customer does not accept these terms and conditions then goods will only be supplied on a cash basis.  The risk in the goods passes to the purchaser on despatch.  Goods and services tax (GST is chargeable where applicable.

Delivery of Goods.

Unless otherwise stated freight is an additional charge, which will include GST.

Overdue Accounts.

Goods will not be supplied to overdue accounts until such time as the account is brought up to date.  We reserve the right to charge account fees not excess of the current bank prime interest rates.

Important Notice To Applicant(s) For Credit (Section 18E(8)(c) Privacy Act 1988) – please read carefully.

The supplier may give information about you to a credit reporting agency, but only limited kinds of information are allowed by the Privacy Act 1988 (Commonwealth).  This includes:

¨      identity details – this only includes your name, sex, date of birth, current address, two

immediately previous addresses, your current or last know employer, your drivers license number.

¨      the fact that your have applied for credit and the amount.

¨      the fact that the supplier is a credit provider to you.

¨      payments overdue for at least 60 days when the supplier has taken steps to recover.

advice that the payments are not longer overdue.

¨      cheques drawn by you which have been dishonoured more than once.

the opinion of the supplier that you have committed a serious credit infringement.

¨      when credit provided to you has been discharged.

Please read carefully before signing.  If more than one applicant, each applicant is to sign.

1.         Giving Information To A Credit Agency (Section 18E(c) Privacy Act 1988)

The supplier has informed me that it may give certain personal information about me to a credit reporting agency.

 

2.         Exchanging Information With Other Providers (Section 18N(b) Privacy Act 1988)

I agree to the supplier checking personal information about me with any credit provide

named in my credit application, and with other credit providers that may be named in a credit

report issued by a credit reporting agency, for any of the following purposes.

¨      to access my credit worthiness.

¨      to help me avoid defaulting on my credit obligations.

¨      to notify a default by me.

I understand that this information can include any information about my credit worthiness, credit standing, credit history or credit capacity that credit providers are allowed to give or receive from each other under the Privacy Act 1988.

I further agree that the supplier may disclose a credit report or any personal information derived from it to another credit provider, for any of the purposes mentioned above.

 

3.         Access To Commercial Credit Information (Section 18L(4) Privacy Act 1988)

In order to access my application for credit, I consent to the supplier obtaining a report containing information about my commercial activities or commercial credit worthiness from a business which provides information about commercial credit worthiness of person(s).

 

4.         Access To consumer Credit Information For A Commercial Credit Application   (Section 18K(1)(b) Privacy Act 1988)

I consent to the supplier obtaining a credit report containing consumer credit information from a credit reporting agency for the purpose of assessing my application for credit.
